All services are subject to a written estimate or proposal. No work will begin without a signed agreement or written authorization from the customer.

3. Estimates and Pricing

Estimates provided by Mainstay Hurst Asphalt Paving are based on the information available at the time of the site visit. Final pricing may change if:

• The scope of work changes after the estimate is issued.
• Hidden conditions are discovered once work begins, such as a deteriorated base, unexpected drainage issues, or subsurface obstacles.
• Material costs change significantly between the estimate date and the scheduled work date.

We will notify you of any material change to the estimate before proceeding with work that would increase your cost.

4. Scheduling and Cancellation

Work is scheduled based on crew availability, weather conditions, and material supply. We reserve the right to reschedule jobs due to rain, extreme heat, or other weather events that would affect the quality of the work.

If you need to cancel or reschedule, please notify us as soon as possible. Cancellations made after materials have been ordered or a crew has been dispatched may result in a cancellation fee to cover direct costs incurred. The specific fee, if any, will be communicated to you at the time of cancellation.

5. Payment Terms

Payment terms will be specified in the written estimate or contract for your project. Common terms include a deposit required prior to scheduling, with the remaining balance due upon completion of the work. Accepted payment methods will be listed on your invoice.

Invoices not paid by the due date may be subject to a late fee. We reserve the right to suspend future work or pursue collection of unpaid balances, including reasonable attorney fees and costs, to the extent permitted by Texas law.

6. Customer Responsibilities

You are responsible for:

• Ensuring clear access to the work area on the scheduled date, including removing vehicles, equipment, and personal property.
• Notifying us of any underground utilities, irrigation lines, or other subsurface features that may be affected by the work.
• Obtaining any permits, HOA approvals, or neighbor consents required for the project before work begins, unless we have agreed in writing to handle permitting on your behalf.
• Keeping vehicles and foot traffic off newly paved or sealed surfaces for the cure period specified by our crew.

7. Warranty Disclaimers

We stand behind the quality of our workmanship. Any warranty on labor or materials will be stated in writing in your project agreement. Where no written warranty is provided, work is provided on an "as-is" basis.

Warranties do not cover damage caused by:

• Normal wear and tear or weathering over time.
• Heavy vehicle loads beyond those anticipated at the time of installation.
• Tree root intrusion, soil movement, or subsurface conditions not visible at the time of the work.
• Failure to maintain the surface, including sealcoating, within recommended intervals.
• Acts of nature, including flooding, extreme freeze events, or storm damage.

Except as expressly stated in a written warranty, Mainstay Hurst Asphalt Paving makes no warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Mainstay Hurst Asphalt Paving shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from our services or your use of this website, including loss of profits, loss of use, or property damage beyond the direct cost of the services provided.

Our total liability for any claim related to a specific project shall not exceed the amount paid by you for that project.
